Defining fuctions, tasks, powers and organizational structure of the Ministry of Science and Technology 


Pursuant to the Law on Government Organization dated February 18, 2025;


At the request of the Minister of Science and Technology;


The Government hereby promulgates a Decree defining functions, tasks, powers and organizational structures of the Ministry of Science and Technology.


Position and functions

The Ministry of Science and Technology is a governmental agency which exercises the function of state management of scientific research, technology development and innovation, high technology and strategic technology development, scientific and technological potential development activities; intellectual property; standards, metrology and quality; atomic energy, radiation and nuclear safety; postal services; telecommunications; radio frequencies; information technology industry, digital technology industry; application of information technology; electronic transactions; national digital transformation; state management of public services in the fields under its management as prescribed by law.


Tasks and powers

The Ministry of Science and Technology performs the tasks and powers prescribed by the Law on Organization of the Government, Government regulations on functions, tasks, powers and organizational structure of ministries, ministerial-level agencies and the following specific tasks and powers:


1. Submit to the Government bills and draft resolutions of the National Assembly; ordinance projects and draft resolutions of the Standing Committee of the National Assembly; draft decrees, draft resolutions of the Government formulated under the Ministry's approved annual law-making programs and plans, and other resolutions, projects and schemes as assigned by the Government or the Prime Minister.


2. Submit the Government and the Prime Minister annual, mid-term and long-term development strategies, planning and plans; works of national significance, programs, projects and schemes in the sectors and fields which it is assigned to manage; decisions, directives and other documents within the competence of the Prime Minister.


3. Promulgate circulars, decisions, directives and other documents about management of the sectors and fields under its state management.


4. Approve 05-year and annual science, technology and innovation orientations, objectives, tasks and plans, science, technology and innovation tasks under its state management in conformity with science, technology and innovation development strategies as decentralized or authorized by the Government or Prime Minister.


5. Direct, provide guidelines on, inspect and take responsibility for organization of implementation of approved legislative documents, strategies, planning, programs, schemes and plans; provide information, propagandize, disseminate and provide education about laws in the sectors and fields under its state management.


6. Issue, amend, supplement, extend, suspend, invalidate and revoke licenses, certificates and registration certificates within the ambit of its state management of sectors and fields as prescribed by law.


7. Regarding science, technology and innovation activities

a) Direct and provide guidelines on the implementation of science, technology and innovation orientations, objectives and tasks, promote the development of key techno-economic sectors and fields by applying, innovating and mastering technologies, developing new, high, digital and strategic technologies and commercializing technologies and results of scientific research and technological development;

b) Perform state management of technology research, development and application activities in techno-economic sectors and fields; provide ministries, central and local authorities with professional guidelines in management of science, technology and innovation activities;

c) Develop, guide and organize the implementation of mechanisms and policies on high technology and high-tech zones; manage and organize the certification of high-tech activities and certification of high-tech enterprises; build databases and information infrastructure on high technology;

d) Perform state management of strategic technology; formulate, provide guidelines on and organize the implementation of mechanisms, policies, programs and measures to encourage and promote the development of strategic technology in Vietnam;

dd) Provide guidelines for determination, order placement, selection, direct assignment, assessment and acceptance of science, technology and innovation tasks; cooperate with the Ministry of Finance in determining value of property which is the outcome of science and technology tasks and intellectual property under regulations of law; transferring the ownership and the rights to use results of scientific research, technology and innovation development funded by the state budget. Utilize, apply, commercialize technology and results of scientific research and technology development; disclose and propagandize results of scientific research, technology and innovation development;

e) Manage science, technology and innovation tasks in the fields under its management; determine, provide guidance on and organize the performance of national science and technology tasks; manage and organize the performance of tasks set forth in the national science, technology and innovation programs and schemes approved by the Prime Minister;

g) Examine, supervise and assess the implementation and post-acceptance of state-funded science, technology and innovation programs, theses and projects as decentralized; independently evaluate results of scientific research, technology and innovation development;

h) Provide guidance on and register the operation of scientific and technological institutions as prescribed by law;

i) Formulate, provide guidance on and organize the implementation of mechanisms and policies for encouraging and supporting the research into and application of technologies and technical advances, and technology incubation;

k) Assist organizations and individuals in assessing, innovating and seeking technologies, transferring, decoding and mastering foreign technologies, utilizing inventions; provide guidance on and evaluate technological level and capability and establish orientations for technology development and national technology innovation roadmap in accordance with law;

l) Formulate and submit to the Government regulations on competence, sequence, procedures and conditions for issuance of certificates of eligibility for provision of technology examination and assessment services; special conditions for human resources and infrastructure to be satisfied by technology valuation service providers, and organize the implementation thereof after their promulgation;

m) Formulate, provide guidance on and organize the implementation of mechanisms and policies for technology assessment, examination, appraisal and transfer; manage the import of used machinery, equipment and technology lines; manage the determination of investment projects using outdated technologies, potentially causing environmental pollution and resource intensification; inspect quality and value machinery, equipment and technology lines of investment projects as prescribed by law; examine or give opinions on technology; give opinions on scientific and technological contents of planning at national, regional, provincial and special administrative-economic unit levels, urban planning, rural planning, technically specialized planning, scientific research and technology development programs and schemes serving technology transfer and development of science and technology market.


8. On innovation and technology market development

a) Perform uniform management of innovation activities; formulate, provide guidance on, inspect and organize the implementation of mechanisms and policies for incentivizing, supporting and encouraging the development of innovation, and calling for investment in innovation;

b) Manage, provide guidance on and organize innovation activities; develop science and technology market and enterprise-centered national innovation system; create and promote a legal environment assisting innovation;

c) Provide guidelines for the establishment, management and development of the system of innovation organizations and innovation support organizations; organize the determination of innovation centers and innovation support centers according to regulations of law; build, operate and develop innovation networks;

b) Manage, provide guidance on and organize the development of science and technology market; promote science and technology market on the regional, national and international scale; intermediary organizations of the science and technology market, technology exchange centers, technology exchanges;

dd) Assist in improving technological capacity for enterprises as prescribed by law; formulate and implement programs and projects supporting the development of science and technology market;

e) Direct and organize technology and equipment markets, connection of technology supply and demand; technology exchange activities, technology transfer promotion; science, technology and innovation exhibitions.


9. Regarding startup and science and technology enterprises

a) Perform uniform management of technology incubation, startup, science and technology enterprises; formulate, provide guidance on, inspect and organize the implementation of mechanisms and policies for determining, recognizing, incentivizing and encouraging the development of technology incubators, science and technology business incubators, technical facilities, co-working spaces, individuals, groups of individuals, startups, startup consultants, startup support organizations, investors for start-up and other entities of the startup ecosystem;

b) Manage and develop the national startup ecosystem; create and promote the legal environment and call for investment for start-up, technology incubation, and science and technology business incubation;

c) Manage, guide and organize the development of a system of organizations supporting innovative startups, technology incubators, science and technology business incubators, technical facilities, and co-working spaces supporting innovative startups; build, operate and develop a national innovative startup network, experts, consultants, and innovative startup investors;

d) Develop and implement programs, schemes and projects to support technology incubation, science and technology business incubation, start-up, support public higher education institutions, public vocational education and training institutions, and other public science and technology organizations in establishing, participating in establishing, and participating in contributing capital to enterprises to commercialize results of scientific research and technology development; direct and organize domestic and international events on technology incubation, science and technology business incubation, and start-up.


10. Regarding development of scientific and technological potential and innovation

a) Preside over and cooperate with ministries, central and local authorities in formulating and submitting to a competent authority the planning for network of public scientific and technological institutions, and organizing the implementation thereof after its promulgation; provide guidance on exercise of autonomy by public scientific and technological institutions; submit to the Prime Minister for promulgation the list of basic and essential public science and technology services; preside over and cooperate with the Ministry of Finance, ministries and agencies concerned in submitting to a competent authority for promulgation and organize the implementation of mechanisms and policies to improve public scientific and technological institutions’ autonomy capacity;

b) Specify criteria for classification, ranking and conditions for establishment, merger, consolidation, re-organization or dissolution of scientific and technological institutions; establish and appraise the establishment, re-organization or dissolution of public scientific and technological institutions in accordance with law; provide guidance on functions, tasks, powers, organizational structure and operating regulations of the Management Council in public scientific and technological institutions;

c) Formulate and organize the implementation of long-term plans to train human resources in science and technology, plans to provide professional training and refresher training and develop expertise in science and technology; organize the provision of professional training and refresher training in science and technology for human resources in science and technology under its management;

d) Promulgate within its competence or submit to a competent authority for promulgation and organize the implementation of mechanisms and policies for training, refresher training, employment and promotion of individuals engaged in scientific and technological activities; policies to attract scientists, qualified experts and intellectuals who are overseas Vietnamese;

dd) Manage, provide guidance on and organize communication, library and statistical activities in relation to science, technology and innovation; manage domestic science and technology publications; build science, technology and innovation information and statistics infrastructure; build and develop national science and technology databases; databases of science, technology innovation; supplement concentrated international science and technology information sources; invest in the development of a national scientific and technological information network connected to regional and international scientific and technological information networks;

e) Design programs, provide guidance on and organize the communication of information about science, technology and innovation activities.


11. Regarding intellectual property

a) Preside over and coordinate with ministries, branches and localities to develop, guide and organize the implementation of mechanisms, policies, strategies, planning, plans, programs and projects on intellectual property;

b) Formulate, provide guidance on, organize and inspect the implementation of regulations of law on intellectual property; prescribe procedures for establishment and transfer of intellectual property rights of organizations and individuals;

c) Perform the state management of innovative activities;

d) Provide guidance on and organize the establishment and transfer of intellectual property rights, including managing the use of variations of geographical indications (“Vietnam”, “Viet”, “Viet Nam”, “Viet”) to register certification trademarks and collective trademarks for national products and services of Vietnam; implement measures to protect the legitimate rights of the State, organizations and individuals in the field of industrial property;

dd) Provide professional guidance on industrial property to regulatory bodies, organizations and individuals; instruct and assist organizations and individuals to manage, operate and develop intellectual property under its management as prescribed by law;

e) Manage industrial property representation and examination and other intellectual property services;

g) Preside over settling disputes over industrial property and commercial disputes related to industrial property in accordance with law;

h) Cooperate with the Ministry of Culture, Sports and Tourism, Ministry of Agriculture and Environment and Ministry of Industry and Trade in performing state management of intellectual property with respect to related fields as assigned by the Government.


12. Regarding standards, metrology and quality

a) Manage activities in the fields of standards and technical regulations; appraise and announce national standards; provide guidance on formulation and appraise of national technical regulations; participate in formulation of international and regional standards; provide guidelines for application of international, regional and foreign standards in Vietnam; provide guidelines for formulation of local technical regulations; provide guidance on formulation and announcement of base standards; manage the operation of the network of notification and enquiry authorities and Cross-sector Committee for Technical Barriers to Trade; manage the national database of national standards and national technical regulations; perform state management of goods labels, numeric codes, bar codes and tracing of products and goods;

b) Organize the development and guidance on the application of national standards and develop, promulgate and guide the application of national technical regulations in the assigned management fields; perform the functions and tasks of the Agency for notification and enquiry on technical barriers to trade in the fields under the state management of the Ministry;

c) Manage the establishment, maintenance, preservation, use, development and application of the measurement standard system; approve national measurement standards; research, deploy, apply, develop, manufacture and produce measurement products, reference materials and measuring instruments; designate an organization to maintain national measurement standards; perform the metrology management of measuring instruments, measurement methods, quantities of prepackaged goods and measurement standards; organize the management of inspection, calibration and testing of measuring instruments and measurement standards; support the innovation and development of measurement activities in enterprises; carry out state inspection of measurement and quality of products and goods labels as prescribed by law;

d) Preside over and cooperate with related ministries and central authorities in performing state management of product and goods quality and tracing during production of goods exported, imported or marketed and in use in accordance with law;

dd) Provide guidance on and manage the assessment of conformity with standards and technical regulations and accreditation of conformity assessment bodies;

e) Organize the research, application and improvement of productivity and quality in sectors and fields; preside over implementing the national program for improving productivity and quality of products and goods; preside over, implement and apply tracing; research, advise, train and apply science, technology and innovation in the fields of standards, metrology and quality; preside over and cooperate with related ministries and central authorities in organizing the implementation of international agreements and treaties in the fields of standards, technical regulations, measurement, productivity and quality of products and goods, goods labels, numeric codes, bar codes, tracing of products and goods and conformity assessment; manage, provide guidance on and organize the application of the advanced system of quality management in agencies and organizations of the state administrative system, organizations and enterprises; manage, provide guidelines for and organize the presentation of the National Quality Award; manage the presentation of product and goods quality awards to organizations and individuals;

g) Organize establishment, management, operation, maintenance and exploitation of databases of numeric codes, bar codes and tracing of product and goods; organize the provision of professional training, coaching and refresher training courses on numeric codes, barcodes and tracing of products and goods for agencies and organizations under the state administrative system, organizations and enterprises.


13. Regarding atomic energy and radiation and nuclear safety

a) Perform state management of atomic energy research, development and application in techno-economic sectors; preside over and cooperate with ministries and central authorities in formulating, providing guidelines for and organizing the implementation of planning and plan for atomic energy development and application to service socio-economic development;

b) Perform state management of assurance about radiation and nuclear safety, nuclear security and nuclear inspection;

c) Formulate and submit to competent authorities for promulgation or promulgate within its competence and organize the implementation of mechanisms, policies and legislative documents on atomic energy development, radiation and nuclear safety as prescribed;

d) Inspect and handle violations of radiation safety and nuclear safety for activities in the field of atomic energy;

dd) Organize the management of the national environmental radioactivity observation and warning network and the system of standardized national laboratories in the field of radiation and nuclear measurement;

e) Perform state management of safety and security of nuclear fuels, spent fuels, nuclear materials, source nuclear materials, radioactive waste and auxiliary services for atomic energy application; manage the import and export of radiation technologies and equipment, nuclear fuels, spent nuclear fuels, nuclear materials and radioactive sources nationwide.

g) Prescribe the control of and response to radiation and nuclear accidents.

h) Prescribe the control of occupational exposure, medical exposure and radiation safety for the public.


14. Regarding postal services

a) Provide guidelines for, organize and inspect the implementation of mechanisms, policies, strategies, planning, plans, projects, schemes and programs concerning postal services; organize the inspection of list of public postal services, support mechanisms and provision of such services as prescribed by law;

b) Regulate, manage prices and quality of public postal services, private postal services, postal services serving affiliates of the Communist Party and the State, and other postal services as per the law;

c) Manage postage stamps and safety of postal operations within its competence;

d) Manage national postal codes and codes of Vietnamese postage stamps;

dd) Regulate and guide the operation of the public postal network and the postal network serving Party and State agencies;

e) Cooperate in management of competition and settlement of disputes pertaining to postal services, and protection of legitimate rights of postal service users as prescribed by law.


15. Regarding telecommunications

a) Provide guidelines for, direct and organize the implementation of strategies, planning, plans, programs, mechanisms and policies on telecommunications, Internet and digital infrastructure;

b) Promulgate and stipulate lists of public telecommunications services, scope, targeted users and prices of public telecommunications services, and mechanisms for supporting enterprises providing public telecommunications services, supporting the use of public telecommunications services, supporting terminal equipment as prescribed by law; organize the execution of public telecommunications services programs;

c) Preside over and organize the implementation of regulations on management of market and competition in the fields of telecommunications and Internet; protect rights of users of telecommunications services and the Internet as prescribed by law;

d) Promulgate and organize the implementation of planning and regulations pertaining to management and use of telecommunications number storages and Internet resources; distribute, grant and revoke telecommunications number storages and Internet resources; organize the auction and transfer of rights to use telecommunications numbers and codes, and “.vn” national domain name;

dd) Promulgate mechanisms, policies, regulations concerning and organize the management of prices in the field of telecommunications and the Internet according to regulations of laws; control and suspend the application of prices of telecommunications services in case a telecommunications enterprise imposes or devalues prices of telecommunications services, which destabilizes the telecommunications market and causes damage to legitimate rights and interests of telecommunications service users, other telecommunications enterprises and the State. Cooperate in managing promotions in the field of telecommunications. Direct and provide guidance on reporting, accounting and audit regimes for the purpose of management of prices of telecommunications services and Internet;

e) Promulgate and organize the implementation of regulations on management of connection between telecommunications networks;

g) Within its competence regulate and provide guidelines for operations of private telecommunications networks serving affiliates of the Communist Party and the State;

h) Guide the development and implementation of plans and schemes for telecommunications network development; direct, guide and inspect the sharing and common use of telecommunications infrastructure;

i) Preside over the assurance of telecommunications infrastructure safety, cooperate with the Ministry of Public Security in ensuring information security pertaining to telecommunications operations as prescribed by law;

k) Manage telecommunications and Internet quality; develop, manage and operate calibration - testing laboratories for telecommunications and the Internet as prescribed by law;

l) Establish, manage, operate and use systems for collection and management of telecommunications figures and deploy terrestrial mobile number portability (portability center);

m) Establish, manage, operate and use the national domain name server system, Vietnam National Internet Exchange VNIX and national internet resources management system, and connect them with regional and international systems;

n) Establish a system and platform to measure the speed of Internet resources and Ipv6. Collect, produce statistics on and publish data on the Internet and Internet resources;

o) Design programs for and organize the promotion of application and conversion of the Internet to the new generation Ipv6, develop industrial Internet, Internet of Things (IoT); promote safe and sustainable development of Internet resources, popularize the “.vn” national domain name;

p) Cooperate with regional and international organizations in registering, receiving and maintaining Vietnam's Internet resources.


16. Regarding radio frequencies

a) Provide guidelines for and organize implementation of the planning for allocation of national radio frequencies; transmission and broadcasting according to the information and communication infrastructure planning approved by the Prime Minister;

b) Preside over and coordinate with the Ministry of National Defense and the Ministry of Public Security to allocate frequency bands for defense and security purposes and submit them to the Prime Minister for approval;

c) Promulgate frequency band planning, planning for division of frequency channels, planning for use of frequency channels, regulations on conditions for allocation, assignment and use of radio frequencies;

d) Manage quality of radio emission, electromagnetic compatibility and radio radiation safety as per the law;

dd) Regulate technical conditions and conditions for employment of radio equipment exempt from licensing;

e) Provide refresher training in and professional guidelines on radio frequencies; manage the training in radio frequencies and issuance of radio operator licenses;

g) Manage fees for issuance of licenses to use radio frequencies, fees for use of radio frequencies, fees for granting the rights to use radio frequencies as prescribed by law;

h) Inspect and control radio frequencies and radio equipment, and handle harmful interference;

i) Register international frequencies and advance international cooperation in radio frequencies and satellite orbits;

k) Propose regulations on auction, examination and transfer of rights to use radio frequencies to competent authorities for promulgation and organize implementation thereof.


17. Regarding information technology industry, digital technology industry

a) Guide, direct, and organize the implementation of strategies, plans, policies, programs, projects, and plans for the development of the information technology industry, digital technology industry, and semiconductor industry;

b) Promulgate or propose policies and incentives for investment in development of information technology industry, digital technology industry and semiconductor industry to competent authorities for promulgation; announce list of key information technology and digital technology products and services and formulate programs for development of such products and services;

c) Appraise programs, plans and projects pertaining on development of information technology industry, digital technology industry and semiconductor industry;

d) Promulgate or propose criteria for assessment and certification of technical features and functions of information technology industry and digital technology industry products and services; mechanisms and policies for management and development of concentrated information technology and digital technology zones;

dd) Promulgate and recognize information technology and digital technology skill standards within its competence;

e) Organize investment and trade promotion activities in the information technology industry and digital technology industry;

g) Manage quality, manage assessment of conformity of products and services in the fields of information technology industry and digital technology industry as prescribed by law.


18. Regarding national digital transformation

a) Act as a standing agency of the National Committee for Digital Transformation; a conduit to review and advise on coordinating cross-sectoral coordination activities between ministries, central and local agencies in order to implement policies, strategies, programs, plans, schemes, mechanisms and policies for the sake of a legal environment which promotes the application of information technology and national digital transformation;

b) Formulate, provide guidance on and organize the implementation of general mechanisms, policies, strategies, plans, programs and schemes for national digital transformation;

c) Issue a set of indicators to assess the level of digital transformation at national, ministerial and provincial levels; organize assessment and publish annual assessment results.


19. Regarding construction and development of e-Government and digital Government

a) Formulate, provide guidance on and organize the implementation of national mechanisms, policies, strategies, plans, programs and schemes for application of information technology in state agencies, construction of e-Government, digital Government and smart cities; provide guidance on, appraise, inspect, evaluate and rank the construction and implementation of programs, plans, schemes and projects on information technology application, construction of e-Government, digital Government and smart cities by ministries, central and local authorities within its competence; evaluate and inspect the quality of products and solutions applying information technology, and construction of e-Government, digital Government and smart cities;

b) Compile and promulgate a list of shared digital platforms of state agencies; announce a list of key digital transformation tasks of state agencies, place orders and assign tasks to digital technology enterprises to perform;

c) Provide guidance on, supervise and inspect the management, exchange and exploitation of data in building e-Government and digital Government according to regulations of law;

d) Establish, maintain, update and adopt the Vietnam E-Government Architecture Framework, Vietnam Digital Government Architecture Framework, and Smart City ICT reference framework; build and provide guidance on the deployment of the Intelligent Operations Center model of state agencies;

dd) Build and operate information system testing laboratories; build, manage and operate the National Data Exchange Platform, Electronic Measurement and Control System (EMC System) for Digital Government Service Provision and Utilization, Government cloud computing platform, platform for management of investment in information technology application and digital platforms serving information technology application of state agencies, construction and development of e-Government and digital Government within its competence;

e) Propagandize and disseminate information on, provide refresher training and coaching courses on information technology application and digital transformation in state agencies, construction and development of e-Government and digital Government.


20. Regarding digital economy, digital society

a) Provide guidance on and organize the implementation of national mechanisms, policies, strategies, laws, plans, programs and schemes for digital economy and digital society development;

b) Guide and evaluate the development, organization and implementation of programs, plans, projects related to digital economy and digital society;

c) Manage and promote the development of digital platform economy and national digital platform to serve the development of digital economy and digital society; propagandize and disseminate information on, provide refresher training and coaching courses on promotion of enterprise digital transformation, new business models applying digital technology, digital skills, digital citizens, digital connections and digital culture, and compliance with the digital code of conduct in society and community;

d) Build, manage and operate information systems and databases for national digital economy and digital society development in accordance with law.


21. Regarding e-transactions

a) Provide guidance on, direct, organize the implementation of strategies, plans, policies, programs, and projects on e-transaction development; legislative documents on e-transactions; technical requirements, technical audits, and audit of quality of products and services in e-transactions;

b) Manage the reporting, measurement, and production of statistics on e-transaction activities; manage the monitoring of security of information systems serving e-transactions by information system owners; build, manage and operate systems for receiving and aggregating data serving the state management of e-transactions by state agencies;

c) Manage e-signatures, trust services, trust service providers; recognize foreign e-signatures, foreign e-signature certificates, foreign electronic authentication service providers in Vietnam according to regulations of law;

d) Manage and organize the construction, exploitation and development of national electronic certification infrastructure, the system for maintaining and checking the status of digital signature certificates; the issuance and revocation of digital signature certificates;

dd) Regulate the connection between systems providing public digital signature and official specialized digital signature services.


22. Establish, manage, operate and use private postal networks and telecommunications networks, and specialized data transmission networks serving operations of affiliates of the Communist Party and the State.


23. Decide on measures to mobilize networks and services, means and information transmission equipment to serve emergencies related to national security, natural disasters and enemy attacks as assigned by the Government and the Prime Minister.


24. Manage public officials and public employees under its management as prescribed by law.


25. Manage, provide guidance on and organize the awarding of the Ho Chi Minh Prize, State Prize for science and technology; other prizes on the sectors and fields under its management as prescribed by law. Organize grant of awards and emulation and reward activities as per the law.


26. Decide and organize application of measures to prevent illegal information and communication activities within the ambit of its assigned functions and tasks as per the law.


27. Conduction inspections and examinations, handle complaints and denunciations, receive citizens, prevent and combat corruption, misconduct and wastefulness, and impose penalties for violations of laws in the fields under its state management as prescribed by law.


28. Provide training and refresher training for development of human resources in the sectors and fields under its management; predict demands and provide directions for development of human resources in the sectors and fields under its management.


29. Manage its organizational apparatus, job positions, payroll, number of persons working for public service providers; decide the appointment, re-appointment, transfer, secondment, dismissal, resignation and relief from duty of personnel, implement salary regimes, regimes and policies on preferential treatment, condemnation, discipline and other regimes for cadres, public officials and public employees; formulate and organize the implementation of plans to provide professional training and refresher training of its cadres, public officials and public employees in accordance with law.


30. Manage allocated finances and assets, and organize allocation and implementation of state budget estimates according to regulations of law; propose the ratio of state budget expenditure on science and technology.


31. Regarding international cooperation and integration

a) Provide guidelines for and organize the conduct of activities aimed at international integration in the sectors and fields under its management as prescribed;

b) Preside over negotiations and consider funding for joint programs and projects with international partners in sectors and fields under the management of the Ministry within the framework of bilateral, multilateral, regional and inter-regional agreements; organize the implementation of bilateral and multilateral cooperation programs, agreements, international and regional integration projects in sectors and fields under the management of the Ministry; deploy a network of science and technology representatives abroad under the direction of the Government and the Prime Minister;

c) Act as an official representative of Vietnam in international organizations in the sectors and fields under its management as assigned or authorized by the Government and the Prime Minister.


32. Perform state management of public services in the fields under its state management; monitor, evaluate, and inspect the quality of public services and the operational efficiency of public service providers in the fields under its management; undertake the task of state management of prices of public services as per the law.


33. Exercise rights and fulfill responsibilities and obligations pertaining to state ownership for state-owned enterprises and state capital invested in other enterprises as prescribed by law.


34. Organize the management of associations and non-governmental organizations operating in the sectors and fields under its state management in accordance with law.


35. Manage off-budget state financial funds under its management in accordance with law; manage and organize the execution of investment projects within its competence as prescribed by law.


36. Organize the implementation of its administrative reform plan under the state administrative reform program approved by the Government or Prime Minister.


37. Perform other tasks and exercise other powers as assigned by the Government and Prime Minister and as prescribed by law.

The units specified in clause 1 through 22 of this Article are administrative organizations assisting the Minister in exercising the functions of state management; the organizations specified in clause 23 through 25 of this Article are public service providers in support of the Ministry’s functions of state management. The National Committee for Standards, Metrology and Quality reserves the right to use the seal bearing the National Emblem.

The Minister of Science and Technology shall submit to the Prime Minister for promulgation a Decision defining functions, tasks, powers and organizational structure of the Academy of Science and Technology Strategy and a list of other public service providers affiliated to the Ministry.

The Minister of Science and Technology shall define functions, tasks, powers and organizational structures of units affiliated to the Ministry within his/her competence.






      Pursuant to the Law on Governmental Organization dated 19th June, 2015; the Amendments to the Law on Governmental Organization and the Law on Local Administration Organization dated 22nd November, 2019;

     Pursuant to the Government’s Decree No. 123/2016/ND-CP dated 1st September, 2016 on the functions, duties, jurisdiction and organizational structure of ministries and ministry-level agencies; the Government’s Decree No. 101/2020/ND-CP dated 28th August, 2020 amending the Decree No. 123/2016/ND-CP dated 1st September, 2016 on the functions, duties, jurisdiction and organizational structure of ministries and ministry-level agencies;

    At the request of the Minister of Information and Communications;


    The Government hereby promulgates this Decree on the functions, duties, jurisdiction and organizational structure of the Ministry of Information and Communications.

Article 1. Position and functions

     The Ministry of Information and Communications (hereinafter referred to as “the Ministry”) is a Governmental agency exercising state management of the press; publication, printing, and distribution; audio and visual broadcasting; electronic information; news; foreign information; grassroots information; the post; telecommunications; radio frequencies; the information technology industry; information technology application; cyber security; electronic transactions; national digital transformation and state management of public services in fields and sectors under the Ministry’s state management jurisdiction.


Article 2. Duties and jurisdiction

    The Ministry of Information and Communications exercises duties and jurisdiction as prescribed in the Government’s Decree No. 123/2016/ND-CP dated 1st September, 2016 on the functions, duties, jurisdiction and organizational structure of ministries and ministry-level agencies, and the Government’s Decree No. 101/2020/ND-CP dated 28th August, 2020 amending Decree No. 123/2016/ND-CP and the following:


    1. Propose to the Government draft bills and resolutions of the National Assembly, draft ordinances and resolutions of the Standing Committee of the National Assembly; draft decrees of the Government in accordance with the annual legislation programs and plans of the Government and with resolutions, projects, and schemes as assigned by the Government and the Prime Minister.


    2. Propose to the Government and the Prime Minister development strategies, allocations, and plans for the long, medium, and annual terms; national target programs, action programs, projects, and works of national importance; programs and schemes for the provision of public utilities and services in the relevant field and sector; decisions, directives, and other documents within the jurisdiction of the Prime Minister.


    3. Promulgate circulars, decisions, directives and other documents on the management of the fields and sectors within the Ministry’s state management limits.


    4. Provide direction, guidance, inspection, and assume responsibility for the implementation of approved legal documents, strategies, allocation, programs, schemes, and plans; provide information and education on the laws governing the fields and sectors under the Ministry’s state management limits.


    5. Regarding the press (including printed newspapers, online newspapers, audio and visual broadcasting, and newsletters)


    a) Provide instructions and guidance for, and organize the implementation of, the development and management of the press, overseas representatives and permanent resident offices of Vietnamese press agencies in accordance with the development plan for the press, broadcasting, electronic information, and publication network approved by the Prime Minister;


    b) Provide information for the press and manage press information; conduct the measurement and publication of data relevant to press activities as prescribed by law;


    c) Promulgate regulations for competitions, conferences, and celebration of the press;


    d) Inspect the legal deposit of press works; manage the national printed press legal deposit system; conduct the electronic legal depositing of audio, visual, and electronic press works as prescribed by law; provide instructions for and inspect the implementation of press release of state administrative agencies as prescribed by law;


    đ) Issue, amend, suspend, and revoke licenses in the field of press and broadcasting; issue and revoke press cards; approve press conferences as prescribed by press law;


     e) Provide instructions for the operation of the press and journalists nationwide, cooperate with relevant agencies to regulate the operation of Vietnamese press agencies relating to other countries and the press operation of foreign individuals and organizations in Viet Nam;


     g) Issue opinions on the appointment of heads of press agencies as prescribed by press law;


     h) Manage the content, quality, and prices of broadcasting services as prescribed by law.


     6. Regarding publication (including publication, printing, and distribution)


     a) Provide instructions and guidance for, and organize the implementation of, the publication, printing, and distribution network in accordance with the development plan for the press, broadcasting, electronic information, and publication network approved by the Prime Minister;


     b) Issue, extend, amend, suspend, and revoke licenses in the field of publication, printing, and distribution as prescribed by law;


     c) Verify and manage the registration of publishers, printing establishments, printing of products exempt from licensing, distribution activities, electronic publishing, and electronic distribution activities as prescribed by law;


     d) Conduct the assessment of publications as prescribed by law; inspect the legal deposit of publications and manage the legal depositing of publications; place order for and transport publications to regions with arduous socio-economic conditions, remote areas, mountainous and insular areas, and border areas; organize national publications fairs and manage the export of publications overseas as prescribed by law;


     đ) Suspend, recall, confiscate, prohibit from circulation, and dispose of illegal publications;


     e) Issue, extend, and revoke editor licenses as prescribed by law;


     g) Manage activities to support publication as prescribed by law;


      h) Issue opinions on the appointment, dismissal, and removal of director generals (directors) and editors-in-chief of publishers.


      7. Regarding foreign information


      a) Assume the leadership role and cooperate with relevant agencies to instruct and guide the implementation of foreign information strategies, plans, programs, and schemes;


      b) Provide content guidelines and foreign information for Vietnamese press and news agencies;


      c) Assume the leadership role and cooperate on inspecting and assessing the efficiency of foreign information services of other ministries, ministry-level agencies, Governmental agencies, People’s Committees of provinces and municipalities, and press and publication agencies in Viet Nam and abroad;


     d) Develop mechanism to exchange, cooperate, provide, and share information between state agencies and the press;


     đ) Monitor, aggregate, and report to the Prime Minister on the provision of explanation and clarification of false information about Viet Nam in various fields.


      8. Regarding advertisements


      a) Exercise duties regarding the management of advertisements in the press, online advertisements, advertisements in publications, and integrated advertisements on postal, telecommunications, and information technology products and services as prescribed by law;


      b) Issue, extend, amend, and revoke licenses to operate infomercial channels and programs for audio and visual news services; communicate the release of advertising inserts for printed newspapers;


      c) Receive notifications of cross-border advertisements service provision in Viet Nam; receive and handle notifications of illegal cross-border advertisements and exercise preventive measures as prescribed by law.


      9. Regarding electronic information


      a) Manage the video gaming service, information content service, and information provision applications on the Internet as prescribed by law;


      b) Issue, extend, amend, suspend, and revoke licenses and certificates concerning online video games and information as prescribed by law.


       10. Regarding grassroots information and district-level broadcasting


      a) Instruct, guide, and implement grassroots information and district-level broadcasting strategies, allocation, and plans;


      b) Create information content for dissemination on the grassroots level under the Ministry’s functions and duties, and instruct the implementation thereof;


       c) Instruct the development and operation of the grassroots information and district-level broadcasting systems;


       d) Provide information for and manage the content of the grassroots information and district-level broadcasting systems nationwide.


       11. Regarding postal services


        a) Instruct, organize, and inspect the implementation of mechanisms, policies, strategies, allocations, plans, projects, schemes, and programs concerning postal services; inspect the lists, support mechanisms, and provision of public postal services as prescribed by law;


      b) Regulate and manage the prices and quality of public postal services, private postal services, postal services in support of the Communist Party and State agencies, and other postal services as prescribed by law;


      c) Manage postage stamps and postal operational safety within the Ministry’s jurisdiction;


      d) Manage the national postal and Vietnamese postage stamps code sets;


      đ) Issue, amend, and revoke postal licenses; issue and amend confirmation of notification of postal operations;


      e) Regulate within the Ministry’s jurisdiction and instruct the operation of public postal networks and postal networks in support of the Communist Party and State agencies;


      g) Cooperate in competitiveness management and dispute settlement in the field of postal services, protect the legitimate rights of postal service users as prescribed by law.


      12. Regarding telecommunications


      a) Instruct, guide, and implement plans, allocation, programs, mechanisms, and policies for the development of telecommunications, the Internet, and digital infrastructure (broadband telecommunications infrastructure, cloud computing infrastructure, and Internet-of-things infrastructure); regulate the telecommunications market; promulgate and regulate the lists, scopes, objects, and prices of public telecommunications services and mechanisms to support enterprises investing in telecommunications infrastructure, digital infrastructure, and providing telecommunications services as prescribed by law; implement the provision of public telecommunications services and duties as assigned by the State;


      b) Assume the leadership role in the development and implementation of competitiveness regulations in the field of telecommunications, telecommunications applications, and the Internet; protect the rights of telecommunications services, telecommunications applications, and Internet users as prescribed by law;


      c) Issue, extend, amend, suspend, and revoke licenses in the field of telecommunications as prescribed by law;


      d) Promulgate and implement regulations and allocation on the management and use of telecommunications number storage, domain names, and IP address; distribute and revoke telecommunications number storage, domain names, and IP address; develop and submit to relevant authority to promulgate and implement regulations on the auction and transfer of the rights to use the telecommunications number storage and domain names, and detailed regulations on auctioning the telecommunications number storage and Internet resources and the lists of telecommunications number storage and Internet resources to be auctioned;


      đ) Promulgate and implement mechanisms, policies, and regulations to manage the prices and promotion offers in the field of telecommunications and Internet as prescribed by law; control and suspend the application of telecommunications prices when telecommunications enterprises overcharge or undercharge for their telecommunications services causing instability in the telecommunications market and infringing on the legitimate rights of telecommunications services users, other telecommunications enterprises, and the State. Direct and provide instructions for a reporting, accounting, and auditing mechanism to support the regulation of telecommunications and Internet prices;


      e) Promulgate and implement regulations on managing the connection of telecommunications networks;


      g) Regulate within the Ministry’s jurisdiction and instruct the operation of the telecommunications network reserved for usage by the Communist Party and State agencies;


      h) Instruct the development and implementation of the plans and solutions to further develop the telecommunications networks and digital infrastructure; direct, instruct, and inspect the sharing and common use of the telecommunications and digital infrastructures;


      i) Assume the leadership role in maintaining infrastructure safety, and cooperate with the Ministry of Public Security to ensure information security in telecommunications activities as prescribed by law;


      k) Manage the quality of telecommunications and Internet services; develop, manage, and operate testing and calibration laboratories in the fields of telecommunications and Internet as prescribed by law;


      l) Establish, manage, operate, and use a system to collect and manage telecommunications figures and a mobile number porting system;


      m) Establish, manage, operate, and use with safety precautions the national domain names server and the Vietnam National Internet eXchange.


      13. Regarding radio frequencies


      a) Instruct and implement the allocation of the national radio frequencies spectrum; operate the transmission and broadcasting in accordance with the information and communications infrastructure allocation approved by the Prime Minister;


      b) Assume the leadership role and cooperate with the Ministry of Defense and the Ministry of Public Security to allocate frequency bands for national defense and security purposes and submit to the Prime Minister for approval;


      c) Promulgate allocation for frequency bands, frequency channels division, and frequency channels use, establish conditions for allocation, assignment, and use of radio frequencies and radio frequency bands;


      d) Manage the quality of radio emission, electromagnetic compatibility, and radio emission safety as prescribed by law;


      đ) Determine the technical and use conditions for radio equipment exempt from licensing, determine the technical conditions (frequencies and transmission capacity) for radio equipment before manufacturing or imported for uses in Viet Nam;


      e) Regulate the training of radio operators; radio operator certificates; eligibility, conditions, and procedures for the issuance, extension, and renewal of radio operator certificates; recognition of maritime radio operator certificates for foreign crew members working on seafaring vessels flying the Vietnamese flag;


      g) Issue, extend, amend, suspend, and revoke licenses concerning radio frequencies;


      h) Inspect and control radio frequencies and equipment, and handle harmful interference;


      i) Register international frequencies and advance international cooperation on radio frequencies and satellite orbits;


      k) Propose to relevant authorities for promulgation and implement regulations on the auction and transfer of the right to use radio frequencies.


      14. Regarding information technology industry


      a) Instruct, guide, and implement the strategies, plans, policies, programs, schemes, and projects for the development of information technology and digital technology industries;


      b) Propose to relevant authorities for promulgation or promulgate within the Ministry’s jurisdiction policies to incentivize and promote investment in information technology and digital technology industries; publish the list of key information technology products and formulate programs for their development;


      c) Examine programs, plans, and projects intended for the development of information technology and digital technology industries, trade and investment promotion content in the field of information technology industry, and projects intended for the development of information technology products funded by the science and technology budget of ministries, departments, and localities;


      d) Promulgate or propose to relevant authorities for promulgation criteria to assess and certify the technical functions and features of information technology and digital technology industries products; mechanisms to regulate and develop concentrated information technology zones;


      đ) Issue, extend, suspend, and revoke licenses and certificates in the field of information technology industry, digital technology industry, and information technology human resources; promulgate and certify information technology skill standards;


      e) Organize trade and investment promotion activities in the field of information technology and digital technology industries;


      g) Perform quality control for products and services in the field of information technology and digital technology industries as prescribed by law.


      15. Regarding national digital transformation


      a) Perform permanent duties of the National Commission for Digital Transformation; act as the contact point to aggregate, advise, and coordinate the trans-sectoral cooperation between ministries, departments, and localities in order to realize the guidelines, strategies, mechanisms, and policies to create a legal environment that promotes information technology application, national digital transformation, and the development of e-Government, digital Government, digital economy, digital society, and smart cities;


      b) Instruct and implement mechanisms, policies, strategies, plans, programs, and national schemes on information technology application in state agencies and the development of e-Government and digital Government; instruct, examine, inspect, and assess the development and implementation of programs, plans, schemes, and projects on information technology application and the development of e-Government and digital Government of ministries, departments, and localities within the Ministry’s jurisdiction; assess and examine the quality of information technology application products and solutions.


Develop, maintain, update, and implement the Viet Nam e-Government Architectural Framework and the ICT Reference Framework for the development of smart cities; instruct, supervise, and support data management and data sharing activities in state agencies; develop and opearte information system laboratories; develop, manage, and operate national data integration and sharing platform, the national data portal, the supervision and assessment platform for e-Government provision and usage, the Governmental cloud computing platform, and other digital platforms to support the development of e-Government and digital Government within the Ministry’s jurisdiction;


      c) Instruct and implement mechanisms, policies, legislation, strategies, plans, programs, and national schemes on digital economy and on the promotion of information technology application and the digital transformation of enterprises as prescribed by law;


      d) Instruct and implement mechanisms, policies, strategies, legislation, plans, programs, and national schemes on digital society and on the promotion of information technology application and compliance with the codes of conduct in the digital environment within society and communities.


      16. Regarding cyber security


      a) Perform management functions on information security; ensure information security for information systems and information technology application and development activities; prevent and counter spam mails; ensure personal information safety in the cyber environment; protect children in the cyber environment; manage and coordinate responses in the case of cyber security incidents nationwide; assume the leadership role in emergency responses to endure national cyber security as prescribed by law;


      b) Manage the manufacture and trade of information security products and services; manage the examination, assessment, and certification of information security; issue, extend, amend, suspend, and revoke business licenses for cyber information security products and services (excluding civil cryptographic products and services; cyber security products and services) as prescribed by law;


      c) Manage the quality of cyber information security products and services (excluding civil cryptographic products and services; cyber security products and services) as prescribed by law;


      d) Develop and operate information security systems and national concentrated technical infrastructure systems to handle and minimize cyber attacks, provide information security surveillance support for information systems that provide online public services and develop e-Government; assess the cyber security level of information system designs and the safety level of information systems; oversee the supervision of information security as prescribed by law;


      đ) Cooperate with the Ministry of Public Security to ensure security and safety of key facilities relating to national security in the field of information technology.


      17. Regarding electronic transactions


      a) Instruct, guide, and implement the strategies, plans, and policies to develop and utilize electronic transactions within the Ministry’s jurisdiction;


      b) Propose to relevant authorities for promulgation and recognition or promulgate and recognize within the Ministry’s jurisdiction the standards in electronic transactions;


      c) Oversee service providers involved in electronic transactions within the Ministry’s management authority as prescribed by law;


      d) Manage the development of technological infrastructure for electronic transactions as prescribe by law;


      đ) Establish regulations on digital signatures and digital signature verification services within the Ministry’s jurisdiction; assume the leadership role in cooperation with the Ministry of Public Security and the Government Cipher Commission in overseeing digital signature verification service providers; provide the digital signature verification service on a national scale as prescribed by law.


      18. Develop, manage, operate, and utilize the postal and telecommunications networks and the data transmission networks reserved for use by and in support of the Communist Party and State agencies in their operations.


      19. Implement, in cooperation with other agencies, legal regulations on intellectual property rights regarding encoded press and broadcasting products, publications, postage stamps, information and communication technology products and services, and eligibility for industrial property rights in the fields and sectors under the Ministry’s management authority as prescribed by law; instruct, in cooperation with other agencies, intermediary service providers to comply with legal regulations on intellectual property rights.


      20. Organize awards, emulation, and commendation programs as prescribed by law.


      21. Establish and implement measures to prevent and counter illegal information and communications activities.


      22. Promulgate and implement national technical standards, request the publication of national standards in the fields and sectors under the Ministry’s management authority; sign and implement mutual recognition agreements on conformity assessment results with other countries and regions; instruct the implementation of conformity assessment in the fields under the Ministry’s management authority as prescribed by law; perform the functions and duties of an announcement and Q&A agency regarding the Ministry’s technical barriers to trade.


      23. Oversee the import and export of products and goods under the Ministry’s management authority as prescribed by law.


      24. Establish measures to mobilize information and communication networks, services, devices, and equipment in the case of emergencies concerning national security and natural disasters as assigned by the Government and the Prime Minister.


      25. Manage and implement investment programs, schemes, and projects in the fields and sectors under the Ministry’s management authority as prescribed by law; implement the collection and utilization of data to support the management of the State and field-specific statistics as prescribed by law.


      26. Manage the assigned finances, assets, and budget as prescribed by law.


      27. Advance international cooperation in the fields under the Ministry’s management authority as prescribed by law.


      28. Develop and implement plans for scientific research and application of scientific and technological progress, developing high-tech products, technological innovation, and environmental protection in the fields and sectors under the Ministry’s management authority.


      29. Regarding public services


      a) Exercise state management of public services in the fields and sectors under the Ministry’s management authority as prescribed by law;


      b) Promulgate or amend the technical-economic standards and expense standards (if applicable) as the basis to establish unit price and price of public services using state budget in order to form the basis of assigning tasks, placing orders, or bidding for the provision of public services as prescribed by law;


      c) Promulgate criteria and standards for the quality of public services using state budget; mechanisms to oversee, assess, and control the quality of and procedures to inspect and assess public services using state budget; and the operational efficiency of public service providers as prescribed by law;


      d) Exercise state management of the prices of public services as prescribed by the laws on prices;


      đ) Instruct organizations to provide their public services as prescribed by law.


      30. Regarding enterprises


      a) Assume the leadership role and cooperate with other relevant ministries and departments to propose to the Government for promulgation mechanisms and policies to encourage and support the development of enterprises in the field of information and communications; cooperate with relevant agencies and organizations to guide, instruct, and inspect the implementation thereof;


      b) Approve or submit to relevant authorities for approval the schemes intended for the comprehensive restructuring and for the innovation and development of state-owned enterprises operating in the field of information and communications assigned under the Ministry’s management and instruct the implementation thereof based on assignment;


      c) Instruct and inspect the implementation of regulations on conditional business sectors and services, and handle violations within the Ministry’s jurisdiction;


      d) Exercise the rights, responsibilities, and duties of a state-affiliated owner of state-owned enterprises and of state-owned capital invested in other enterprises as prescribed by law.


      31. Exercise duties and jurisdiction with regards to associations and non-governmental organizations within the Ministry’s state management limits as prescribed by law.


      32. Inspect, examine, receive citizens, resolve complaints and accusations, prevent and combat corruption, and handle violations of the law in accordance with the Ministry’s state management functions.


      33. Establish and implement plans for administrative reform and administrative procedure reform in the fields and sectors according to the Government’s and the Prime Minister’s national administrative reform programs and plans; recommend or determine within the Ministry’s jurisdiction the implementation of state management stratification based on fields and sectors.


      34. Train, educate, and develop the human resources under the Ministry’s management authority; conduct demand forecasting and development orientation for the information and communications human resources.


      35. Manage the Ministry’s staff apparatus, tenure, cadres, officials, and public servants; ensure remuneration and other entitlements for cadres, officials, public servants, and other employees under the Ministry’s management authority as prescribed by law.


      36. Exercise other duties and jurisdiction as prescribed by law.

The Minister of Information and Communications will stipulate the functions, duties, jurisdiction and organizational structure of the Ministry’s affiliated units in accordance with the laws.


      Article 4. Effect

      1. This Decree takes effect on 26th July, 2022.


      2. This Decree supersedes the Government’s Decree No. 17/2017/ND-CP dated 17th February, 2017 on the functions, duties, jurisdiction and organizational structure of the Ministry of Information and Communications.


      Article 5. Responsibility for implementation


      Ministers, Heads of ministry-level agencies, Heads of Governmental agencies and Chairpersons of People’s Committees of provinces and municipalities are responsible for implementing this Decree.
